Dzhokhar Tsarnaev is awake at the Boston's Beth Israel Deaconess Medical Center where he is being treated and question and he has not been read his Miranda Rights due to the police not knowing if there are anymore bombs.

Without him being read the rights can what he say be used against him or no? Im a little leery if we dont. he is only being tried federally. not as an unlawful combatnat.
From what I've read on mirandarights.org a person's Miranda Rights are intended to protect the person's 5th Amendment right to refuse to answer self-incriminating questions but if an arrest wasn't made police can ask any question that they want but the person can walk out at anytime they want. it also makes it so that you can ask for your lawyer present without looking as suspicious. In the video below it does show how one suspect got a "not guilty" verdict because the police didn't read the client the Miranda rights.
